ALLEGATIO CONTRA FACTUM NON EST ADMITTENDA

(An allegation contrary to a fact is not to be admitted)

Principle and application.

This maxim is most commonly applied in the area of evidence law. A fact would mean something real and verifiable that is, something that is known to be true and can be proven with evidence. The maxim basically means that once a fact has been proven and accepted in court, no one is permitted to bring up allegations that contradict that fact.

This rule only applies after a fact has been ultimately or conclusively proven in court. At that point, contradictions from any party are not allowed but before that point, the defense is free to challenge the prosecution.
